Add the employee name, ID number, position, and department. Add the name of manager or supervisor handling termination. Include any severance, benefits, and compensation the employee is entitled to. Detail any company property employee is expected to return.
Check your past feedback. Give them a warning. Focus on specific behavior goals. Fire early in the week and never on a Friday. Make it short, sweet and to the point. Do not let the employee linger. Ask for a release, and give the employee an incentive to sign it. Reassign the terminated employee's job duties promptly.
Sample termination letter (Layoff, without cause) Dear [Employee Name], We regret to inform you that your employment with [Company Name] is being terminated, effective [date termination is effective]. This decision cannot be changed. We are terminating your employment for financial reasons.
Termination without cause occurs when an employee is terminated from a job not because they have necessarily done anything wrong, but because the employer has decided, for whatever reason, that it no longer needs the employee's services.
The simple answer is no. The main purpose for a signed release is to create a clean break between employee and employer. The signed release is a legal agreement that protects both parties from the risk of future legal action.
Federally, and in most states, a termination letter is not legally required. In some states, currently including Arizona, California, Illinois and New Jersey, written termination notices are required by law. Even if your state doesn't require a termination letter, they can be valuable to the business and the employee.
You can refuse to sign a termination letter. No one can force anyone to sign anything. Anything otherwise would be duress. If your employer does not allow you leave the premises until you sign a termination letter, you can write on the document that you refuse to sign the letter and/or you are under duress.
It is common for an employer to ask a dismissed employee to sign a release related to all potential outstanding claims that he or she might have. Speaking in general terms, an employee is not required to sign such a release.
If you mean a termination of employment letter, absolutely. You're under no legal obligation to sign anything proffered by your employer unless it has to do specifically with payroll. There are documents the employer must file with the State (separation notice) when somebody is terminated and that should suffice.
