For pdfFiller’s FAQs

Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
Once a police department has sufficient evidence (probable cause) that a suspect is the most likely candidate for a crime, it will approach a judge to issue an arrest warrant. A warrant for your arrest means a law enforcement officer has the right to take you into custody wherever you are.
An arrest warrant is a warrant granted by a judge in a court of law to a law enforcement official granting that law enforcement official the right and ability to arrest a person of interest regarding a crime. Arrest warrants are most commonly required when a crime is committed out of view of a police officer.
All this is providing that we don't have to find additional evidence to get the judge to agree that there is probable cause to issue the warrant. So the short answer is, it could take anywhere from 10 minutes, to 6 hours.
The claim that warrants are usually executed within 48 hours is simply not true, at least in the US. While felony arrest warrants may be the archetype, bench warrants for the arrest of persons failing to appear on citations are nearly certainly more numerous.
A judge will issue a felony warrant if law enforcement officials show probable cause that a felony was committed. They must also have reasonable suspicion that you are the person who committed the crime. Also, unlike many warrants, felony warrants can be served anywhere, not just in a specific geographic area.
The initial court appearance is usually pretty brief (1-10 minutes). The main actions that occur at the initial appearance are: The judge will provide the defendant with a copy of the criminal complaint. The complaint will list the charge or charges and the maximum possible penalty upon conviction.
Initial appearance refers to the defendant's appearance before a judge within few hours of his/her arrest. Such an appearance is made to determine whether there is a probable cause for his/her arrest. The preliminary examination date is usually decided at the initial appearance.
The first step in any Family Court custody case is the filing of the petition. If there has never been any court intervention before, the petition merely needs to allege why the petitioning parent feels he or she would be the person better able to take care of the child or children.
During the initial appearance, the judge typically asks the defendant if he will need public representation, has secured a private attorney or will be representing his own case. At an arraignment, the defendant's attorney is typically present to help him enter in his official plea.
An arraignment is a criminal proceeding where the defendant is called before a judge in a court, informed of the charges (either in writing or orally, but usually just in writing) and asked to enter a plea of not guilty, guilty or no contest.
It means that something came up that stopped the initial appearance, preventing the Court from executing the requirements of an initial appearance. This could be anything from a mental health issue of a defendant, an emergency in the court, something going on with the defense attorney or the state's attorney, etc.
At the Initial Appearance, the State formally files the charges against you in the form of a criminal complaint. This happens in 99.9% of cases. It will list the counts of the different crimes and offenses you are being charged with, as well as stating some particulars concerning those offenses.
If someone has a warrant out for his arrest, he will usually stay in jail until the sheriff is able to bring him before a judge. This is usually 48 to 72 hours after the arrest, excluding weekends and holidays.
Call the court you suspect issued the warrant and ask the clerk about it. See if you can schedule a hearing to take care of the matter. If you were supposed to appear for a traffic ticket, ask if you can reschedule or simply pay the fines. The clerk will lay out your options.
Pay any associated bond. Report to the judge. Go through a bondsman to pay the bond with surety. Pay any fines associated with the warrant. Hire an attorney to quash the warrant.
