Is a signed faxed document legally binding?

A faxed signature is legally recognized as valid and is often used to confirm or approve many business and financial deals. If a contractual agreement is broken, and there is a denial that any agreement took place, a fax of the original signed document is deemed to be sufficient evidence in court.

Can you fax original documents?

Fax copies can be considered legal documents and are often accepted as such in many agencies and establishments. Thanks to the almost flawless anti-tampering method when it comes to faxing, many businesses will accept a faxed copy of an original document, such a signed contract, as legally binding.

Are scanned documents considered original?

Having a scanned signature(s) on a document is valid. This has to be the case in a world where we are more likely to work with someone geographically far, than local. To reiterate, having a scanned signature on a contract is perfectly acceptable under law. But acceptance isn't the issue.

What is faxed copy?

A fax (short for facsimile and sometimes called telescoping) is the telephonic transmission of scanned-in printed material (text or images), usually to a telephone number associated with a printer or other output device. The receiving fax machine reconverts the coded image and prints a paper copy of the document.

Can power of attorney be faxed?

Many firms accept fax copy of POA. Some do not. Practice varies by firm. Never surrender the original POA with your wet signature.

Is a signed PDF document legally binding?

Digital signatures on PDF documents are legally binding in many countries around the world. According to these acts, A document or signature cannot be denied legal effect or enforceability solely because it is in electronic form.”

Is a copy of a signed contract legally binding?

The term “counterpart” is used in legal documents to describe a copy of a contract which is signed and is considered legally binding, in the same way as the original. In many cases, several copies of a contract document are prepared, so that all parties and signatories can have a copy of the contract.

Can a legal document be signed in pencil?

Usually, a signature is simply someone's name written in a stylized fashion. However, that is not really necessary. The signature can be made by anything that marks the paper. Pencil is not favored because it can smudge and be erased, but a signature made with a pencil is equally valid as a signature in pen.
