Congress first addressed the issue of junk faxes in the Telephone Consumer Protection Act of 1991 (CPA). Although this legislation dealt broadly with larger issues of nuisance telemarketing tactics, it included provisions making it illegal for any person to send an unsolicited advertisement to a fax machine.
Call the sender and opt out from their list. In the United States, the 2005 Junk Fax Prevention Act requires all fax marketers to provide a way for receivers to opt out of future faxes. Usually they will provide an opt-out telephone number, but sometimes they will provide a fax number, a website or an email address.
What Does a Fax No Answer Alert Mean? In layman's language, it means that the receiving fax machine may not be available, or the connection between the two machines has failed. In some cases, your fax machine may not have received a signal from the other fax machine, hence the no answer error.
A fax machine is a great convenience, as it allows you to receive facsimiles of documents, including signature copies, in your home or office via a telephone line. You can block them using a call-blocking service or a number-blocking feature that exists on your fax device.
Under the Junk Fax Prevention Act of 2005, the sender of an unsolicited advertisement sent to a person's fax machine is still liable for a minimum of $500 per page, and damages may also be trebled at the court's discretion upon a finding that the violation was willful or knowing.
All unsolicited fax advertisements must contain a notice on the first page of the advertisement that the recipient can opt out of receiving future unsolicited fax ads from the sender. The opt-out notice must be clear and conspicuous and must be separate from the advertising copy or other disclosures.
And, unlike the EBR exception for telemarketing calls that expires 18 months after a purchase or three months after an inquiry, the EBR for unwanted faxes has no defined shelf life. Under FCC rules, once established, the EBR exists until you (or the sender) terminate the relationship.
