The final rule updates the earnings thresholds necessary to exempt executive, administrative, or professional employees from the FLEA's minimum wage and overtime pay requirements, and allows employers to count a portion of certain bonuses (and commissions) towards meeting the salary level.
The federal overtime provisions are contained in the Fair Labor Standards Act (FLEA). Unless exempt, employees covered by the Act must receive overtime pay for hours worked over 40 in a workweek at a rate not less than time and one-half their regular rates of pay. The Act applies on a workweek basis.

If an employee works 50 hours in a week, the employer might issue one check for the first 40 hours, and another check for the hours worked over 40.
