E-Verify is an Internet-based system that compares information entered by an employer from an employee's Form I-9, Employment Eligibility Verification, to records available to the U.S. Department of Homeland Security and the Social Security Administration to confirm employment eligibility.
ABOUT E-Verify. E-Verify, authorized by Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (INDIRA), is a web-based system through which employers electronically confirm the employment eligibility of their employees. E-Verify is administered by SSA and U.S. Citizenship and Immigration Services (USCIS).
Employers who participate in E-Verify must: Follow E-Verify procedures for each employee for whom an E-Verify case is created. Notify each job applicant of E-Verify participation by clearly displaying the Notice of E-Verify Participation and the Right to Work posters in English and Spanish.
A case result of Verification in Process means that DHS cannot verify the data and needs more time. The case is automatically referred for further verification. DHS will respond to most of these cases within 24 hours, although some responses may take up to 3 federal government working days.
Unless an employer is a federal contractor with a federal contract containing the FAR E-Verify clause, it cannot use E-Verify for existing employees. Employers should not go back and create a case for any employee hired during the time its account was inactive and there was deliberate non-use of E-Verify.

A: Employers must retain I-9 forms for at least three years, or for one year following the employee's separation from the company, whichever is later. It is a best practice to store all I-9 forms together in one file since they must be produced promptly following an official government request.
E-Verify was originally established in 1996 as the Basic Pilot Program to prevent undocumented migrants and other people who have violated immigration laws from obtaining employment illegally in the United States. In August 2007, DHS started by requiring all federal contractors and vendors to use E-Verify.
The hire date is the date the employee began (or will begin) work for pay. Accepted an employment offer before the employer may complete Form I-9 and create a case in E-Verify. Employers must enter the hire date from the 'Certification' area in Section 2 of the employee's Form I-9.
Regarding the time required to complete the setup of an E-Verify account: Via Direct (Self-enrollment): Complete the application form at the USCIS E-Verify site[1] : 5 minutes. Receive a temporary username and password from USCIS: 15 minutes to three weeks.
Companies enroll to verify employment eligibility of employees. Most enrolled companies have more than one person who uses E-Verify to create verification cases. There is no limit on the number of users an enrolled company may register to create cases.
The E-Verify client company ID number, which consists of four to seven numerical characters, is located on the top of each page of the client's memorandum of understanding. Program administrators who have completed the tutorial may also find the client ID number. Log in to E-Verify.
By law, E-Verify is mandatory for the federal government, as well as federal contractors and subcontractors. Seven states have E-Verify laws that require all or most employers to use E-Verify including Arizona, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, and Utah.
Employers may request termination electronically through E-Verify (see Terminate Company Account Process Overview) or by submitting a written termination notice by email to E-Verify@dhs.gov.
