A California eviction notice is a letter given to a tenant when they have violated their lease agreement. The notice will detail the specific violation and how many days the tenant has to cure the issue. If the tenant adheres to the notice, they will be required to vacate the premises or face eviction.
A landlord can use a 30 day-notice to end a month-to-month tenancy if the tenant has been renting for less than a year. A landlord should use a 60-day notice if the tenant has been renting for more than one year and the landlord wants the tenant to move out.

The Landlord starts an eviction case in court. If the tenant doesn't do what the Notice says by the deadline, the landlord can file an eviction case (called an unlawful detainer). The landlord must have a copy of the court papers delivered (served) to the tenant. The tenant has a few days to file a response in court.
If the tenant does not pay the rent within 3 days of receiving the 3-day period, he or she must still move out in 30 days. If the tenant does not move out after the 30 days, then the landlord has to file an unlawful detainer case.
How Long Does an Eviction Take? If you file an Answer to the Summons and Complaint, it will take at least 4-6 weeks even if you lose your case before the Sheriff evicts you. Sometimes it can take much longer, especially if you have a good case or if you aggressively defend your eviction on legal and procedural grounds.
