Your guide to transfer tax forms

Transfer tax is determined as payment for passing a title or property from one owner to another. A property transfer tax may be charged by a state, county, or municipality for the privilege of transferring real estate within the jurisdiction. The amount of the transfer tax depends on the property's classification and value.

Importantly, transfer tax is levied when requesting the legal registration of transfers of real estate, bonds, stocks, and stamp duty. Consequently, the IRS offers specially designed real estate transfer tax forms.

The applicants who pay federal taxes should file forms 709, 706, 8288 (8288-A, 8288-B). Here are some basic details about these reports:

01
Form 709 is U.S. Gift (and Generation-Skipping Transfer) Tax Return. It includes a section for General Information, Tax Computation, and Signature.
02
Form 706 is U.S. Estate (and Generation-Skipping Transfer) Tax Return. The taxpayer must submit this statement for all decedents who died after the 31st of December 2012.
03
Form 8288 is U.S. Withholding Tax Return for Dispositions by Foreign Persons of U.S. Real Property Interests and consists of two parts. The first part must be completed by the buyer or other transferee required to withhold under section 1445(a). The second part is for the use of an entity subject to the provisions of section 1445(e).

Forms 8288-A and 8288-B are almost the same as a conventional 8288, but they have some specific conditions for those filling them out.
