In the second part Srivastava explains the concept of legal framework in India and the Indian regulatory framework under the TPA, covering the issue of geographical indications. These legal frameworks are based on a comprehensive interpretation of the TRIPS Agreement and the legal basis established for its enforcement. The purpose of this paper is to provide a detailed picture of geographical indications by considering some major issues raised in the field of enforcement. It is hoped that this will enable the readers to have an understanding of the complexities of enforcement and the various remedies available in the field of enforcement. The Indian jurisprudence has developed an extensive framework through a comprehensive interpretation of the TRIPS Agreement. The TRIPS Agreement has been interpreted in a manner that provides Indian government its powers under the Convention. An examination of the TRIPS Agreement will also clarify how to interpret law as regards protection of geographical indications in India. Indian courts are expected to interpret and apply the TRIPS Agreement based on legal grounds based on the specific requirements of the Convention. Indian courts do not attempt to make laws that will suit the public. Indian courts also endeavor to interpret the TRIPS Agreement and the TRIPS Agreement alone. They do not use the TRIPS Agreement and take its provisions in isolation. Indian courts base their understanding on the requirements under TRIPS. The laws and regulations are developed to give effect to law under the TRIPS Agreement. In an attempt to provide a comprehensive interpretation of the TRIPS Agreement and the legal provisions, Srivastava has adopted a comprehensive and international legal framework for the Indian jurisprudence to consider the issues of protection and enforcement of geographical indications in India. This framework of interpretation is intended to provide a solid ground for interpretation and enforcement of the TRIPS Agreement. The focus of the legal framework in this paper is the protection of geographical indications in India. It is not a comprehensive examination of the enforcement issues. It is not the intention of the present paper to review all enforcement issues in India. The focus of these discussions is on the legal and sociocultural framework that have developed in India for the protection and enforcement of the protection of geographical indications arising in its territory for trade in goods and services. It is hoped that this paper will provide a broader understanding of the legal and sociocultural framework of India in relation to geographical indications and enforcement through the examination of the legal framework. The discussion of enforcement through the examination of the enforcement provisions of Indian legislation is beyond the scope of this paper.
