This Court, after review of the record, would uphold the Commission's action which imposed regulation of a dangerous product. We decline to take note of the Court's comment that the Commission, in imposing an effective standard, had “demonstrated that its own analysis reflected a reasoned decision to protect the health and safety of children.” In my view, however, the issue presented can be reduced to the following. It is the Commission's position that the proposed standard is justified under the Federal Hazardous Substances Act. . . . Thus, the question is whether the Commission is justified in requiring that consumers buy and use lighters that meet the applicable standard. . . . . . . [A] manufacturer who is found to have violated regulation cannot evade liability by using certain other products, and may be required by the court to disgorge money obtained by violation, for those products. The plaintiff who purchases a single-use multi-purpose product is entitled to relief for violations of this action. . [Emphasis added.] The Court points out that the rule applies only to multi-purpose lighters; if the Commission had chosen not to impose such a rule, it could have imposed the equivalent standard for single-use brands. That argument is entirely without merit, because of the Commission's decision to require all lighters that are not single-use to be multi-purpose. In effect, the Commission chose the safer of two alternatives, and, as for multi-purpose lighters, the Commission will not be permitted to choose for itself. The Court's statement that “the Commission, in imposing an effective standard. . . . [was] demonstrating that its own analysis reflected a reasoned decision to protect the health and safety of children” is a misstatement. The Commission's analysis did not reflect a reasoned decision to protect the health and safety of children, because it allowed the use of lighters whose use could injure children and, worse, did not impose the same type of standard on single-use products. To the extent that the Court's statement is correct, however, the Court's statement is merely a commentary on the Commission's conduct.
