Box 30094 Washington, D.C. 20049 (D) (INDEPENDENT COUNSEL TO THE PRESIDENT) TOO LOW TO ACTIVATE METHODOLOGY FOR INTELLIGENCE ACTIVITY The Secretary of Defense has reason to believe, as a matter of public record, that the International Trade Commission (ITC) is violating the Executive Order No. 12985 of October 28, 1967, by permitting the use of software provided by Motorola for the analysis of raw data being supplied by members of the National Intelligence Organization (NIO). As a result, the Secretary has determined that ITC has not been operating within the lawful authority of section 4 of the Act for Intelligence Activities, and is therefore, in effect, suspending use of Motorola's proprietary software to provide that analysis and is authorizing the Department of Defense to begin using a software package developed by EMC International for the analysis of raw data being supplied by NIO. The results of this investigation indicate that despite that suspension, the Department has not been able to obtain as nearly as possible equivalent performance from any other software package, in terms of the available intelligence or other processing capability, in conducting its own analyses, which analysis may have been required by the Department or other intelligence agencies. In addition, ITC has refused to cooperate fully with the investigation, and, as a result, the investigation has been impeded from reaching its objectives. While the use of Motorola's proprietary software is now being resumed for NIO in accordance with the terms and priorities originally specified in the ITC, ITC is still refusing to cooperate fully and provide any documentation requested, as well as to permit the Department access to its computer resources used by Motorola. INTRODUCTION The Department of Defense has had no experience with computer software developed by Motorola for the National Intelligence Activity in the past. Such software is typically used to provide information processing capabilities for the Intelligence Community and other Intelligence Agencies and functions of the Department of Defense.
