Summary of Proceedings
A hearing was held on October 27, 2003, to determine whether to impose fines under the CPA. A notice of correction of record pursuant to Sec. 2.1(d)(6) of these rules followed on October 27, 2003, and was filed with the Register. The Notice of Correction of Record did not address the burden of compliance.
After the Notice of Correction of Record became effective, the Federal Aviation Administration (“FAA”) issued its notice of proposed rule making that contained proposed fines in the range of 500 to 8,500 for each violation, for violations occurring during the period beginning October 1, 1999, through January 1, 2003 (the “Rules and Regulations Reporting Period”) and, under a modification, for violation occurring beginning January 1, 2005, until January 1, 2007 (the “Reporting Period”). This proposed rule making was announced in the Federal Register on September 28, 2003, and the proposed rule was published as an Administrative Notice of Proposed Rule making in the Federal Register on January 22, 2004.
