At every significant step in this litigation, the United States, through the United States Court of Appeals for the Fifth Circuit, has sought to restrict the jurisdiction of district courts and to preclude the exercise of en band review. In this matter the United States Circuit Court of Appeals for the Fifth Circuit (hereinafter the Fifth Circuit) is a part of the United States Department of Justice. It is a separate legal entity from the United States district court system (the district courts). In essence the Fifth Circuit has taken an “independent” position on matters outside the district court's jurisdiction and has imposed a number of special rules that further limit the district court's jurisdiction. [2] The rules that we address are the provisions of Rule 41.2 which provide for the granting, by the district courts, of “unlimited relief” from sanctions. Rule 41.2 is part of a wider “uniform arbitration rule making regime” enacted by the Congress in the Federal Arbitration Act (hereinafter “FAA”). The FAA, which has a number of subsidiary legislative acts, is administered and enforced by the Federal Trade Commission, a part of the United States Department of Justice. [3] The Fifth Circuit was directed to create an “affirmative duty to grant in all cases, and in every matter otherwise within the jurisdiction of the district court, review of, and to impose appropriate sanctions on, all findings by an arbitrator or arbiters in accordance with the provisions of this rule.” FAA § 1.4(d), (f); see United States v. State Farm But. Auto. Ins. Co. of Cal., 872 F.2d 1117, 1119 (5th Cir. 1989) (en band).
