As of September 2006, the majority—27 states and the District of Columbia—had enacted legislation to authorize or require licensed gun dealers to perform background checks at various points during the process of completing a firearm purchase or sale, and eight of these states require that sellers perform background checks on potential purchasers at closing. The NICE is designed to help states effectively enforce their policies prohibiting the sale or possession of semiautomatic assault weapons and to ensure that individuals unable to demonstrate a “good reason” to lawfully own a firearm have access to firearms for legitimate purposes. NICE checks are also required when a person under a domestic violence or sexual aggression restraining order wishes to purchase a firearm.
