The U.S. Department of Justice (DOJ) has licensed firearms dealers (“dealers”) to do background checks on certain individuals, with the goal of preventing individuals who may be prohibited from possessing or receiving firearms from purchasing a firearm. In 2005, DOJ began requiring states to conduct NICE checks on all transfers between individuals who, as well as sales at firearms shows, are not conducted through licensed dealers. These laws apply to people who are not already prohibited from owning firearms. As of October 2005, there are at least 21 states, the District of Columbia, and Puerto Rico that have a prohibition on the purchase or possession of semiautomatic assault weapons, the most popular class of firearms in the United States. These laws include California, New Jersey, Massachusetts, Connecticut, New York, and Texas, and are the subject of current litigation in federal and state courts in several jurisdictions. As of September 2006, the majority—27 states and the District of Columbia—had enacted legislation to authorize or require licensed gun dealers to perform background checks at various points during the process of completing a firearm purchase or sale, and eight of these states require that sellers perform background checks on potential purchasers at closing. The NICE is designed to help states effectively enforce their policies prohibiting the sale or possession of semiautomatic assault weapons and to ensure that individuals unable to demonstrate a “good reason” to lawfully own a firearm have access to firearms for legitimate purposes. NICE checks are also required when a person under a domestic violence or sexual aggression restraining order wishes to purchase a firearm.
