The initial surcharge is equal to the difference between the regular monthly benefit rate and the surcharge rate, and is payable on the first payment of unemployment compensation. There are no other conditions to qualify for the surcharge. An additional surcharge option that is available to certain types of employees is known as a “precharge.” The surcharge required for precharges is paid immediately upon hiring of the individual, unless it was part of the initial offer of employment (i.e., subject to approval) or it would be paid automatically following the employee's employment until all unemployment compensation benefits had been paid. In order to qualify, to precharge must be in accordance with the standard employment agreement. The employer cannot use to precharge payment as a means to avoid the payment of the regular monthly unemployment compensation in which case to precharge is a “charge for delay.” Benefits are received over a ten-month time period, or after a three-year period, whichever comes first (except as provided for in Chapter 11 of Title IV of the Federal Public Assistance Unemployment Compensation Reauthorization Act of 2008 [42 U.S.C. 2901 et seq.]), unless a longer period is specifically provided by the statute. Note: The information in this part may be inaccurate due to editing or formatting errors. In calculating a precharge for delayed payment, this section is referred to as the section of the law which covers preorder for workers having a preorder contract with an eligible employer. If an employer has a contract with an employee or with a subcontractor and provides a preorder contract with an employee who was a part of the preorder contract with the employer at the time of the preorder, the employer can use to precharge paid by the employee pursuant to the preorder to delay the payment date for the individual from the earliest date of hiring to receive benefits.
