BACKGROUND The state's sex offender registry is based upon the records of sex offenders who were classified as “sexually violent predators.” In New Jersey's current classification system, any person who has been convicted in any court of a “sexually violent crime against a child,” or “aggravated sexual assault” is required to register as a sex offender unless the individual's release or modification to a lower classification is granted by the courts for good cause or by the governor. There are several classes of such offenders who, under existing law, may be considered for registration or may be exempted from registration or classification as a sex offender. Included on this list are those convicted of “aggravated sexual assault,” although the statute doesn't define that term. Some of these offenders have been sentenced to “life without parole,” while others may be eligible for parole or release from custody “under specified circumstances.” The Sex Offender Registration Act (SORT), which went into effect on September 30, 2001, creates the basis for such “good cause or other reasons” exemptions. Although the SORT has been criticized for its arbitrary application, there is one benefit: It encourages sexual recidivism in the community by providing an opportunity for individuals who are on parole or in community custody to provide information to law enforcement that may eventually lead to their further supervision or arrest and prosecution for their sexual crimes. Although the statute's wording has evolved over the years, its purpose remains the same: to give a chance to sex offenders to show good faith efforts over a certain period of time to comply with the requirements of registration and/or classification. The New Jersey Statewide Sex Offender Registry was founded by The Coalition Against Sexual Assault, Inc. (CAST), a nonprofit community organization working to prevent rape and sexual assault in New Jersey. The registry's stated goal is to “promote awareness of sexually-motivated crime and to eliminate its occurrence through information exchange among law enforcement, health facilities, victims, and the public.” In 2004, as part of Project SAFE, New Jerseyans nationwide were invited to participate in a nationwide initiative that provided the public with free Internet access and interactive information on how to identify and report a sex offender. At first glance, a sex offender's name is not displayed on the New Jersey Statewide Sex Offender Registry by law.
