(1) A permit application submitted under division (A)(1)(a) of this section shall be accompanied by a copy of each written report or study that the Ohio department of natural resources considers relevant for the review and approval of the planned method of discharges. An application for a permit to discharge under this section shall be submitted to the Ohio environmental protection agency no later than March 1 of the year for which the permit is sought, provided the department of natural resources notifies the Ohio environmental protection agency in writing of its intent to receive the application for a permit to this discharge, the location from which the discharges will be made, and the effective date of the permit if applicable. No permit may be issued until the Ohio environmental protection agency receives the written demonstration provided in division (A)(1)(b) of this section. (2) The permit applicant shall file the permit application or permit application supplement with the Ohio environmental protection agency, and shall notify the Ohio environmental protection agency within twenty days of its receipt of a copy of the application. (B) The Ohio environmental protection agency shall promulgate a rule within ninety days after the receipt of the application for approval of the proposed method of discharge and, except by way of a showing of good cause, the director of the Ohio environmental protection agency is authorized to make any rules necessary to effectuate and implement the provisions of this section. (C) A permit may be approved only if the Ohio environmental protection agency determines that the application is in the best interests of the residents of the affected county and the proposed method of discharge results in a less intrusive and adverse environmental impact.
