Introduction ¶ Defendants sued Hawaii Public Schools in the state court for the district of Hilo. They alleged a claim for injury to their intellectual property arising from the distribution of pre-school textbooks containing the defendant's copyrighted and trademarked copyrighted works. ¶ District Court found that plaintiffs were not entitled to royalties or statutory damages because they had not had time to file a motion for an injunction. Because plaintiff failed to meet the standards of fair use, district court ordered a permanent injunction. However, district court did not issue that order for various reasons and left that issue on appeal. ¶ 1. Fair Use. ¶ Under federal law, when a person is using a copyrighted work for “critically important news, educational programming, parody, satire, or comment upon current events,” they are not considered the author of the copyrighted work but rather a “composer” who may benefit from the use. ¶ The fair use doctrine is codified in the Copyright Act of 1976. Section 107 defines a copyright “to include any copyrightable work” and requires the author to “give to the public a copy of the work Congress added section 106A to the Copyright Act to clarify that in order to be eligible for statutory damages, copyright owners must be able to demonstrate that their infringing works have “actually made their products and ideas available.” They must also show that their infringement is “useful.” ¶ Accordingly, any use not falling within the Copyright Act's “critically important” test is fair use. The consideration was that in the case of a defendant with actual ownership of a copyright he would ordinarily enjoy immunity from such action by the plaintiff in such a case with a good faith argument, while the plaintiff would have to prove actual copyright infringement in order to obtain compensation.
