Each retail pharmacy that dispenses a controlled substance that is listed in Schedule II, III or IV to a person who is an outpatient. c. Each retail pharmacy that uses a computerized system to record information concerning prescriptions and that dispenses a controlled substance that is listed in Schedule I if one or more of the following criteria are met: 1. The pharmacy has a DEA registration based on a controlled substance registry number as required by Section 571B of the Federal Food, Drug and Cosmetic Act (21 U.S.C. 355b). 2. The pharmacy reports to the DEA registration information regarding the specific prescriptions dispensed for the controlled substance at the time the pharmacy records and maintains the information in the computerized system. 3. The pharmacy is subject to DEA regulation based on data received pursuant to Section 571A of the Food, Drug, and Cosmetic Act (21 U.S.C. 355a). 4. The pharmacy has received DEA registration based on a controlled substance registry number as required by Section 571B of the Federal Food, Drug and Cosmetic Act (21 U.S.C. 355b). 5. The pharmacy reports to the DEA registration information regarding the specific prescriptions dispensed for the controlled substance at the time the pharmacy records and maintains the information in the computerized system. (1) No person, other than patients and their caregivers, shall sell or otherwise provide, in this state, or cause to be sold or provided, to a patient, caregiver, or any other person located in this state, any controlled substance listed in Section 40-1.5-101 (1) or (2), 40-1.5-102 (1) or (2), or 40-5-101 or in any other schedule of Schedule I in the substance's entirety, other than as otherwise provided in subsections (3) and (4) of this section. This subsection (1) shall apply only to a person who dispenses the substance or provides the service for a fee. (2) A person licensed under this article shall not knowingly sell or dispense to a patient, at the location where the substance is dispensed, any controlled substance listed in Section 40-1.
