These regulations are adopted pursuant to the provisions of the Department of Agriculture Act, W.S. 84-15-101 (1998). Section 4.(1) Definitions. As used in these regulations, the following terms shall have the following meanings: (A) Corn. Corn, whether harvested, planted, or not, or both, is those dry, roasted seeds, kernels, or other pieces of the plant. (B) Grain container. A portable container, enclosure or package designed to transport and store corn, whether harvested, planted, or not, or both, as a commodity. © Retailer. An individual who engages in the business of selling corn or storing, in any form or manner, corn. (D)(1) Storage. Storage of corn, including, but not limited to, the storage of such corn in containers, cabinets, bins, bins and trays. (2) Buying. Purchasing. Purchasing of corn using credit or debit cards, debit checks, debit drafts, checks, money orders, debit cards, debit checks, or money orders for the purchase of corn. (3)(a) The term “buying” means purchasing or attempting to purchase corn using any of the methods outlined in subparagraph (D)(2)(a)(i) through (iv), such as checks, debit checks, cashier's checks or money orders; purchases over the telephone (excepting purchases made by the person seeking the purchase); or other means of identifying the person or the transaction on which the purchase is placed. (b) The term “attempt” means the act of attempting to purchase corn. © The term “commercial solicitation” means the sale of corn directly to a person who engages in the business of purchasing corn. (f) The term “commercial sale” means the sale of corn to a buyer who does not engage in the business of purchasing corn. (4) Use of credit or debit cards, debit checks, debit drafts, or money orders. The purchase of corn for storage purposes using credit or debit cards, debit checks, debit drafts, or money orders from merchants who conduct business on a general or frequent basis at a location other than the location at which the person intending to purchase corn is located.
