Examples of the types of evidence or evidence bases that may be considered to indicate the inability to perform a specific job function are as follows: • Unrelated medical condition or medical disorder • Unrelated physical condition or dysfunction • Unrelated psychological condition or dysfunction • Unrelated physical disabilities or dysfunction • Other evidence as determined by the Secretary, based on the facts of the circumstance. The Secretary will determine whether such evidence supports or opposes the request for medical examination, or any other specific documentation, required by this part (i) for any person under this part regardless of his or her rank or pay grade, (ii) to support a request for a fitness for duty evaluation for any person (as specified in this part) on the basis of a reasonable medical opinion. This provision will not be construed to require further medical examination or testing of any employee who is a candidate in the selection process or within the jurisdiction of the Secretary when such an examination or testing, or combination thereof, is not medically necessary. (iii) If the Secretary determines that the fitness-for- duty evaluation was not medically necessary, the following statement may be included in the explanation of absence: “The medical evaluation indicated that the employee could perform his/her job or duties and/or was able to return to duty within 14 days. The absence for the purpose of a fitness for duty evaluation does not in any way impair the employee's ability to perform his/her job or duties or to return to duty within 14 days.” (iv) For positions of military specialties as described in subpart E of this part, an approved fitness-for-duty evaluation (either one or more fitness-for-duty evaluations) must be completed within 30 days (unless an earlier date is agreed to in writing by the Secretary) after notification to the Department and the affected employee of the decision to perform an evaluation. If the Secretary has not completed an exercise or other training that covers the specific medical evaluation requirements of the specific military specialty within 30 days of the notification to the Department, he or she may submit an alternative form to the Department that will be accepted. In such case, the alternative form and the alternative form submission shall be forwarded to the responsible office or to the concerned commanding officer, as specified in subsection (e)(8)(iv) of this section, within 15 days after the employee is notified for a specific fitness-for-duty evaluation.
