TAA was designed by Congress to assist unemployed U.S. workers who lost their jobs because of the increased imports from the countries involved in a free trade agreement. It provides for payments that help individuals find suitable work. It enables government subsidies such as tax credits to encourage work. Furthermore, it allows workers to continue to claim unemployment compensation for the duration of temporary unemployment. (The law has also required the secretary of labor to make rules for eligibility of eligible families when applying for assistance.) The law provides for an increase in the maximum wage for a displaced worker. It requires the secretary of labor to issue regulations for unemployment insurance for such workers. It requires the secretary of labor to administer and enforce compliance with TAA. The law also requires the secretary of labor to report to Congress on how the assistance programs of this law are working. Also, TAA allows workers displaced from a job because of imports from the affected countries to receive payment for any income lost because of the employment. However, the worker cannot receive this income immediately. The worker must wait up to 60 days after becoming an eligible worker before taking any amount of public assistance such as food assistance. A worker can also take TAA up to 180 days after becoming unemployed while an unemployment insurance claim is pending, but must wait until all the claims have been resolved before applying for public assistance. In addition, federal law prohibits public assistance if a worker claims unemployment benefits for benefits that are less than the TAA payments. The law also provides that, when workers are separated from the job because of an increase in trade, they pay the difference between the TAA payment for the job and the worker's own social security payment. The law also requires the secretary of labor to submit a report to Congress on the impact of this legislation on the working poor. NAFTA: This law established the North American Free Trade Agreement (NAFTA), which was signed in 1992, and which has the effect of preventing a U.S. Congress from changing the law providing assistance and wage increases for unemployed workers. It allows compensation to be paid by individuals to individuals for an extended period of time after they become unemployed, and it limits the amount of compensation to that paid by the individual to a maximum of 12 weeks. During any subsequent period, the maximum compensation may be made in a lump sum. The law permits compensation to be provided upon the occurrence of another loss of employment, provided that the individual is entitled to compensation.
