2, 5 (2) The definition of “resident” means a person who, under the legal system in force in his or her place of residence, is entitled to do business in that place, including a person or class of persons entitled to do business in a mutual fund trust that is registered under this Act or a mutual fund trust that is not registered unless that person or class of persons does business in that mutual fund trust. 6 (2.1) A person must not, in Saskatchewan, engage in a form of banking in contravention of any prohibition in the International Banking Act, unless the banking is done pursuant to a registration with the Canada Deposit Insurance Corporation under this Act, a registration within the meaning of the Mutual Fund Dealers Act or a registration with the Canada Deposit Insurance Corporation in which the person or class of persons is registered for a permitted purpose of that Act. (3) A person may not, in Saskatchewan, engage in business as a securities' dealer unless the person has been registered under this Act by the Canada Deposit Insurance Corporation as a securities dealer or has been registered under the Mutual Fund Dealers Act as a mutual fund dealer. (4) A person may not, in Saskatchewan, engage in any business that provides legal, administrative or financial services or goods that are not a banking business within the meaning of the International Banking Act. (5) [Repealed 2000-42-22.] 2, 3 (6) Without restricting the generality of subsection (1), other provisions of this Act, other than sections 37, 42 and 43, apply to a mutual fund trust registered under this Act as they apply to a mutual fund trust registered under this Act. (7) A mutual fund trust registered under this Act must establish a public register containing data respecting the financial assets, liabilities and other information, including the types of securities, securities-related assets and securities-related rights, in the trust. (8) [Repealed 2000-42-23.] 3 (11) A mutual fund trust registered under this Act must maintain a reasonable system of internal control and, despite section 24 of the Mutual Fund Dealers Act, each person registered under this Act shall be subject to the regulations imposed under it in the event of a material change in the system of internal control.
