If the holder of the Water agrees to be bound by this covenant, the water may be removed by him, but shall pay a fine of ten dollars for each damage done by him. If the holder of the water does not agree, to the covenant, he may apply to the Secretary for permission to do so. 6. In case of a disagreement between the Owner and the contractor, either one of these parties may apply to the Secretary for final decision. 7. If the Secretary decides there is no dispute between them, he shall issue a written order giving notice of his decision to the Owner who shall take his DDL in that day. If after hearing the Owner and the Contractor, the Secretary considers it expedient he shall appoint a second of the parties who applied to him for a hearing and shall send him within ten (10) days after the second of Said parties apply, a written order to that effect. 8. The second of the parties applied for and in possession of the water shall hold it in trust for the Owner ; and his powers and duties shall be the same as were originally assumed by the owner of the water. If the second of the parties applies to the Secretary for a hearing, and the owner refuses to receive said second, if the Secretary grants a hearing to said second and if the owner denies the second. Request for a hearing, or if the Secretary finds that there is a disagreement in the powers or duties assumed by the owner of the same, the second Application to the Secretary shall be considered a third Application to the Secretary by the Owner.
