CERTIFICATION AND CERTIF?ATION ISSUANCE. Section 1918(g)(1) of the Social Security Act (42 U.S.C. 1396r(g)(1)) is amended by adding the following after paragraph (4): (4) Not less than 15 days after the date on the day preceding the effective date of certification, the certifying entity shall issue a certificate stating that, with respect to policies described in subclause (II) of this paragraph, the certification has been made and has the official seal of the certifying entity which bears the seal of the certifying entity and the State insurance commissioner who issued the certificate and which has been used in the previous year (or for at least one prior year). PUBLICATION AND USE OF COST ESTIMATION. Publicly available cost estimation services shall be made available to States, and to private entities with which the State has entered into an agreement under clause (ii) of subsection (b)(4)(B) and are in compliance with subparagraphs (I), (II), (III), and (IV) of paragraph (4) of such subsection, for use in certifying qualified State long-term care insurance programs under this section. (iii) EXCEPTION FOR STATE HEALTH SHARE MANAGERS. Nothing in this subparagraph is intended to affect the treatment of State health share administrators under section 332 of the Public Health Service Act (42 U.S.C. 256 m). (B) DATE.— (i) IN GENERAL. Not later than January 1, 2013, the dates specified in clause (ii) of subparagraph (A), as such subparagraph and section 223(g)(5)(B) of the Social Security Act (42 U.S.C. 1396n(g)(5)(B)) are amended by inserting after ``January 1, 2012'' the following: ``; and'', and (ii) BY ADDING UPSTARTS AS FOLLOWS: (I) SECTION 1 4(a)(34)(A) OF THE AGENDA REVIEW PROGRAM ACT (42 U.S.C. 1397ee(a)(34)(A)).
