The insurance cover is a contract to provide protection to the member in the case the insured is involved in the accident, or in the case of a failure to deliver the goods in respect of which the contract exists. The coverage relates to the following situations: The insured is in any of the following situations: a) In an accident with the insured. b) In a journey which is in excess of 100 km. and the insured is a travelling merchant or a private passenger travelling on the insurance company's transport services. c) In a transport service to or from which the insured is directly or indirectly employed, or is a member of staff. d) In a transport service which has transported or was transported by a third party. e) In the case of any failure to deliver the goods for which the contract exists. g) In the case of the provision of other service to the insured. f) In the case of a transport service without any transport service to or from which the insured directly or indirectly employed, or is a member of staff. g.) In the case of any failure to deliver the service. In the event that the insured becomes injured or ill, this insurance cover shall also apply, unless this is specifically excluded by a subsequent clause in the contract. This warranty is in addition to the express warranty afforded by law to the insured and is therefore not a separate warranty under the laws or from the contract. The insured shall be solely responsible on the occurrence of a failure to deliver the subject of this guarantee, but only if, prior to or at the onset of a breach, the insured has notified to APS and the insured's employer, as follows: a) in the case of a transport service by which the insured holds directly or indirectly, or is employed, any responsibility in regard to the insurance coverage or the delivery of the goods as a representative of the insured, at the relevant time and with reasonable diligence. b) in the case of a failure to deliver the subject of this guarantee, at that time and with reasonable diligence. As compensation of the insured, APS and the insurer shall be entitled to reimbursement up to an amount equivalent to the value for which each passenger is covered by his insurance, provided that it is known in advance to APS and the insured company.
