The Act defines an athlete agent as any agent or person employed by a school and who is acting in the interest of a school or a prospective educational institution in entering into a contract with a student-athlete. Any student-athlete who has an agent (as defined in the Act) is considered to be a current student-athlete. The Act defines an institution as an entity that provides any facility or supplies for a high school, college, or university, as long as it is operated for educational purposes and is not the primary place of a student's education. The Act defines a school as an education institution, a post-secondary institution, or any other person, group or organization that provides a curriculum within a certain geographical area. In addition, an institution that provides an athletic training facility, sports-related activities, or athletic scholarships is also considered a school. The Act defines an educational institution that provides a secondary education program only as one that provides instruction for up to 12 credits per term to students in grades nine through 12, including instruction in courses including algebra, high school international education, English composition, college preparatory subjects such as history, economics, and statistics. No more than 10 credits per term may be provided in courses offered solely for credit by way of a certificate or diploma. No more than three credits per term may be provided in courses offered solely by way of a certificate or diploma. Any program of instruction for a student shall provide instruction in at least 8 full-time credit hours in classes or grades eight or higher per term. An institution's eligibility for student-athlete financial aid is limited to student-athletes who have met the following criteria: Student-athletes have been a part of a full academic-enrollment high school team. Student-athletes who are part of a registered club, varsity or competitive athletics program that is not a varsity sport, except that clubs shall be considered as a secondary sports team. An institution shall not provide sports scholarships for a student-athlete in a varsity sport until such time as the institution and the institution's program of instruction have agreed on an additional sport to be played for athletic scholarships. An institution shall not provide athlete ships in a varsity sport to student-athletes who are not in full-time academic status except where the institution and its program of education agree to another sport to be played for athletic scholarships.
