First, the Act authorizes you to carry on a business subject to the limitations set out above. The conditions are only those that are necessary for the purposes of the Act. The Act also permits you to do one or more of the following: operate an establishment that is not a registered establishment (subject to conditions that may be prescribed); enter into a contract for the sale of travel services to persons outside Canada; enter onto the premises of a travelling companionship; provide facilities for the delivery of travel services in the course of your own business; enter into a partnership agreement with a person or persons for the purpose of carrying on a business that is not a registered establishment. These provisions, which are referred to as “exemptions”, are detailed in Section 9 below. Some circumstances in which you can be exempt from provisions of the Act include: the provision of services to persons who are unable to give their informed consent as defined in the Act; the provision of services to persons who are unable to show their authorizations for service; the provision of services by registered establishments to their members; the provision of travel services not directly related to the purpose for which the registered establishment is established; the provision of travel services with the consent of the foreign business traveler prior to his or her arrival in Canada or his or her movement to and from the country; services rendered as a result of a prearranged arrangement with a foreign business traveler and the travel to and from the country; the provision of services that are reasonably necessary for the protection of an establishment's premises from or against trespass or theft and in the case of a business establishment's premises in a place such as a hotel or motel for the period before your business is permitted to begin. In addition, Section 11 allows you to operate a business solely to acquire goods or services abroad that you cannot otherwise obtain at home. The provisions of Section 10 apply to all travel services provided to a public (including travel to and from a business or residential premises), such as travel agents, tour operators, tours operators, travel advisers and tour leaders, and persons travelling in their capacity as a member of the public as defined in Section 12 of the Act, and to members of the family and visitors who are not members of the public.
