Subsection 27(1) is amended by adding “(a)” before clause (l)(b). Section 27(1.1) states that an appeal is allowed if all the following requirements are met: 1. The Minister accepts the appeal; 2. The appeal is for an appealable decision in respect of an environmental penalty (i.e. penalty for a violation of section 21 and inapplicable to an action, non-action, license, permit or similar authority); 3. The decision sought to be reviewed is on the same grounds (i.e. same violation, for the same action, authority, license or non-license, etc.); 4. The decision sought to be reviewed relates to the same event (i.e. same activity which caused the penalty); 5. The Minister is satisfied an adequate defense has been advanced by the respondent (i.e. evidence of compliance is available in the appeal); 6 on a balance of probabilities, the information sought should also be available in the appeal; 7. The information sought is relevant to the appeal; 8. The reasons upon which the Minister is relying are supported by the evidence, or appear to be based on the evidence, or are otherwise in accordance with the law; and 9. The Minister is satisfied the appeal will result in a proper reconsideration of the information, reasoning and grounds of the decision. The Environment Appeal Board (EAT) will act on the appeal unless the Board determines that it would be inappropriate, and that an alternative expeditious means of getting to a decision would be available to the parties concerned. Section 27(1.1) then states that the Board will review the decision appealed against and confirm, reverse or amend the decision. Section 27.1(1), is then amended to read: (1) The Board or, on its discretion, other member of the board as it may direct, may hear and determine any matter arising out of an appeal under this section and, with respect to an appeal from an order of the Minister under subsection (2), (3) or (4), of the Environment Appeal Board, the Board or such member shall hear and determine all matters of which the appeal is based and shall render a decision and render a public report thereon.
