This new requirement applies to all mortgagee entities that are eligible to order appraisal services from the appraiser certified under the National Association of Estate Appraisers (“NAME”). The new, more stringent requirement applies to FHA loans insured by the Federal Housing Administration (“FHA”) in excess of amounts that a reasonable appraisal estimate for the loan applicant could justify on an appraiser's fee basis. This revised appraisal requirement applies to any mortgagee entity that is: in addition to participating in the appraisal process for FHA-insured mortgage applications; or. Responsible for the appraisal of an FHA-insured loan, regardless of what entity is ultimately responsible for that loan. The mortgagee entity that is responsible for an FHA-insured mortgage loan must be a participating party involved in the appraisal and has an appraisal representative with appropriate appraisal management experience and certification. The new appraisal requirements do not apply to FHA-insured loans for which the appraisal is performed as part of a loan modification or re-sale program. In addition, the original requirements for attesting to appraiser independence under Fannie Mae's mortgage servicing rule, 7 CFR 230.9(f)(4)(ii), apply to FHA-insured mortgages. These requirements were also updated and clarified to ensure that the Federal Housing Administration does not inadvertently create and perpetuate the perception among lenders that appraisers are not independent to the extent that they do not participate in the mortgage loan appraisal or do not retain independent records of the appraised value. To clarify the impact of the new appraisal requirements, we have updated the Frequently Asked Questions (FAQs) to address the most frequently asked questions about the new appraisal requirements. As amended, the following FAQs now appear at the end of these Frequently Asked Questions: Q: Has this requirement been in effect since August 2006? A: Yes. The original requirement for attesting to appraisal independence was implemented in July 2006 and applied to all mortgagee entities (including affiliates) that are: in addition to participating in the appraisal process for FHA-insured mortgage applications; or. Responsible for the appraisal of an FHA-insured loan, regardless of what entity is ultimately responsible for that loan. Q: Are mortgagee entities eligible to order appraisals in excess of an amount that is reasonable based on a reasonable fee basis? A: No.
