I am not talking about the West Bank or Gaza. I am talking about the West Bank and the Gaza Strip, and the occupied territories in general. Furthermore, I am writing to you from Jerusalem. Jerusalem is a city of violence. The violence is on every square inch. If we do not come up with a more reasonable way of addressing the problems now faced by Israelis and Palestinians in the occupied territories, there will, in fact, indeed be a third intifada. The reason was made clear last month in a letter I sent to President Clinton, warning him of the potential for violence in Jerusalem in the near future. There is an increasingly tense Israeli-Palestinian confrontation in Jerusalem, sparked by tensions over the construction of the separation wall, which could endanger the very existence of our city and its holy sites. That separation wall is designed to separate Jerusalem from its West Bank neighbors and Israel's Arab citizens. In this letter I explained the dangers of any action that could provoke a similar violence. Two weeks ago, Israel enacted new laws making it easier for Israeli troops to arrest any person they deem threatening to the Jewish state's existence, regardless of where they are in the West Bank. The law was named after Anon Adkins, who was arrested by six policemen in the West Bank for carrying a knife in his pocket. In the ensuing scuffle, the knives that Adkins is alleged to have carried were confiscated. Adkins was convicted of attempted murder by the Israeli military and served three years in prison. On July 15, Israel's Justice Minister, Shaw Nathan, announced his intention to pass a law allowing Israel to imprison people indefinitely without trial. While I appreciate the right of Israel to protect itself and its soldiers, the current law has many serious limitations that go beyond Israel's obligation to protect its citizens. First, Israeli authorities must make an arrest before the individual is even charged with a crime. This means that Israeli police officers must have reasonable suspicion to make an arrest. In many cases, police officers have had to wait until someone is shot and killed to even start questioning someone. Second, the maximum period of military detention in Israel is only four days or six weeks, but Israeli courts are notorious for holding people for as long as years. Third, Israel often issues administrative arrest warrants for citizens outside of Israel, requiring the police find and arrest an Israeli citizen who is to be questioned outside of Israel. Fourth, if an Israeli police officer fails to arrest someone in the West Bank, the military can usually arrest the alleged suspect in Israel within 24 hours.
