It also provides for the protection of all property owners from unreasonable or illegal demolition of their historic buildings. The ordinance creates three special use districts along the city's waterfront and in an area near the former Batavia Shipyards. The new districts would include six structures that are at the very least 20 years old and have been declared eligible for historic tax credits by the U.S. Department of the Interior. By amending the Batavia Municipal Code, the City Council recognized these districts and provides for a set of ordinances that will provide a stable and equitable funding source for this protection program. The new ordinance will allow the city to build on the historic district program initiated in 1987 and for the development of future conservation programs that will benefit city property owners as well as all of our citizens. HISTORY : The Batavia Municipal Code was adopted in 1978. SECTION 1. Chapter I. — Planning and Zoning. (a) General Provisions. (1) The City Council is vested with the authority to: design and develop new and rehabilitate parts of the city's waterfront and create additional waterfront areas. (2) No part of the city bank is a protected historic structure. (b) Specific Powers Required. — In addition to its powers as provided under Subsection (a), the City Council shall: designate portions of the waterfront which are a priority in the development of the waterfront, where development shall concentrate at locations that meet the requirements of subsection (a). © The creation of any part of the coast shall be reserved to the City Council or any district within the City Council that adopts the land plan and other land management regulations referred to in Section 32 of this Code. (d) Subject to the provisions of Sections 12, 12-16, 17, 17-2, 18, 19-21, 22, 23, 24, 25, 26, and 28, the City Council may acquire and hold waterfront lands in its jurisdiction for development with an economic return to the City.
