WHEREAS from the time of the taking of title in 1864 until July 20, 1995, there was no such local control over the use, siting and size of buildings and structures, the provision of parking, landscaping and screening, and the subdivision of the land for Keats Island and surrounding area as is now proposed hereunder. WHEREAS due to the nature and the location of Gambler Island, which lies opposite the head of the mainland, the island was originally settled by the Keats family in 1844 and had been for many years, after the occupation, a private home for the Keats family. WHEREAS the use, siting and size of buildings and structures, the provision of parking, landscaping and screening, and the subdivision of the land for Keats Island and surrounding area, including the surface of the sea, has been changed and subdivided from time to time by the Municipality with the consent of the Keats family. WHEREAS due to the nature of Gambler Island, which lies opposite the head of the mainland, a development within a development, with the consent of the Keats family, is therefore a development which the Municipality does not have the power to control, or that the municipality does not have the power to approve under any circumstances, and that a development does not by its nature and location constitute development within a development because of its location, nature, and location. WHEREAS the municipality is of the opinion that the continued occupation of the Keats family's residence by others to continue the residence or the development of a private home has caused and threatens to cause damage to the property, the use, siting and size of buildings and structures, the provision of parking, landscaping and screening, and the subdivision of the land for Keats Island and surrounding area, including the surface of the sea. WHEREAS the proposed construction on the surface of the land of buildings and structures to cover a large area of the Gambler Island, surrounding area, including the surface of the sea, would require the construction of new roads, streets, sidewalks, retaining walls and other improvements, which would be very expensive and might result in the loss of the land which had already been purchased and occupied by the Keats family as a private home for many years.
