The provisions of this ordinance do not apply to the owner or occupants of privately constructed dwellings in any manner except by written ordinance. 1.4 APPLICATION. The provisions of this ordinance do not apply to any existing building in any city, town or village of the state owned by, or leased to, the United States Government, or to dwellings that are operated under a federal program approved by the United States Department of Housing and Urban Development. 1.5 COMPLIANCE. No person shall construct any residential dwelling, including, without limitation, a new or existing building, structure or facility, or any combination thereof, that includes a mechanical ventilation system, an electric heating system or air conditioner, or other heating system for residential use, except that construction of new or existing buildings, structures or facilities, or some combination thereof, that include mechanical ventilation systems, electrical heating systems or air conditioning systems as required by this chapter shall not be required unless each individual unit of such structure is equipped with such a ventilation system. 1.6 CONVENTIONAL GASES. No person shall construct, install, or operate any gas supply, except an existing system approved prior to the adoption of this ordinance, gas ventilating apparatus, furnaces with a heat generating capability of up to 50,000 Btu, or air conditioners with a heat generating capacity of up to 50,000 Btu. 2. DESIGN PROCEDURES For purposes of this ordinance, the term “dwelling” does not include a structure that meets any of the following criteria and is not subject to inspection: (a) A building in which the primary occupancy is single family residential; for purposes of this paragraph, the term “primary occupancy” means, for any building where there is only one dwelling unit, a primary occupancy of the unit and that unit's occupant(s); (b) A structure that includes a kitchen, but that also contains a bathroom; (c) If a dwelling has an interior, interior stairs and/or a roof, a dwelling is considered “dwelling” unless the stairs, roof or interior are required to access a different building or structure; (d) If a dwelling has a covered-walled enclosed porch, a dwelling is considered “dwelling” unless the porch or enclosed structure extends entirely to the exterior and in which case the area of the porch, enclosed structure or porch area, as an integral part of a dwelling, is considered to be “dwelling.
