All boiler and pressure vessel operators shall meet and be certified or registered under the North Carolina Business Registration Act. A. Any person licensed under Article 16 of Chapter 95 of the General Statutes shall comply with all the provisions of Article 16 of Chapter 95 of the General Statutes governing the issuance and maintenance of the North Carolina Business Registration Act. B. It shall be the duty of the Department of Labor, Licensing and Regulation or any other licensing or regulatory body or officer authorized to issue certificates of public convenience and necessity to investigate all applicants for licenses under the North Carolina Business Registration Act. C. Every person licensed under this Article shall have his or her name, physical address, and a description of the boiler that is being worked on certified by a licensed plumber, electrician, or other licensed professional in the field of construction work and such other information as may be necessary to properly identify such boiler. The Department of Labor, Licensing and Regulation or any other licensing or regulatory body or officer authorized to issue certificates of public convenience and necessity to any boiler shall require every such boiler operator shall obtain and retain a certificate of public convenience and necessity prior to any such boiler being operated. Upon compliance in whole or in part with this requirement, the department shall issue the boiler operator a certificate of public convenience and necessity. D. Every boiler shall display the certificate of public convenience and necessity, a color photographic reproduction of which is available to the public. E. The Department of Labor, Licensing and Regulation or any other licensing or regulatory body or officer authorized to issue certificates of public convenience and necessity shall maintain a central registry of any certificates of public convenience and necessity issued under this Section. F. The Department of Labor, Licensing and Regulation or any other licensing or regulatory body or officer authorized to issue certificates of public convenience and necessity shall maintain and make available for public inspection a copy of the certificate of public convenience and necessity which issued to the boiler operator. The department shall charge a one time fee to provide each boiler operator such certificate.
SECTION 2. G.S. 95-69.11 reads as rewritten: Section 1 of this act shall apply to all boiler and pressure vessel operators. A. Any person operating a boiler or pressure vessel shall comply with all the provisions of this Article and any other applicable law of this State and shall submit an application for a certificate of public convenience and necessity upon proper application.
