SHORT TITLE.-This bill may be cited as the “2011 Omnibus Labor Law Changes Act.” 2. DEFINITIONS.-As used in this act, unless the context indicates otherwise: (1) “Employee'' means a person who performs services or is employed by an employer; (2) “Workplace'' means an actual place at which an employer is engaged in an activity that results in pay, salary, or any other remuneration; and (3) “Workstation'' means a machine, plant or machine room at which an employer installs or assembles any equipment to perform work. (4) “Misconduct'' has the meaning given in G.S. 50-20.2(b). (5) “Labor commissioner'' means the labor commissioner appointed pursuant to G.S. 159-31.0. (6) “Labor unit'' means a place where an employer engages in any occupational activity that results in pay, salary, or any other remuneration or includes (a) an industrial facility as defined in Article 1A of Chapter 161A of the General Statutes, (b) a place where workers of a particular labor classification assemble, (c) a place where an employee's work is performed, (d) an employee store or warehouse, (e) a temporary employment center operated as an employer's permanent business establishment, or (f) a temporary employment center organized or controlled by an employer. (7) “Employers'' means those persons who employ more than fifty bona fide employees. As used in this subsection “place” means any structure or area wherein employment of the foregoing persons or any other persons is conducted. (8) “Occupational activity'' means any act that directly or indirectly carries a substantial risk of serious physical harm or death. (9) “Workday'' means a period of time during which an employee is engaged in an occupation or has the opportunity to perform an activity in which he or she reasonably expects to have some direct or indirect input as to its result.
