Child Protection. 2.2.2 DIVERSION POLICY The Board of Directors of the Welsh Swimming Association are in favor of diversion. This includes a broad spectrum of recreational or competitive swimming for both boys and girls for social, health and family purposes. This Policy sets out the following principles or standards we hope will be observed which in turn will aid decision-making: — All boys and girls under 16 are allowed to participate in any recreational or competitive swimming and in any competition at all. — All swimmers must be able to meet and exceed the requirements of the Sport Act 2002, with the exceptions being those children and young persons with physical or mental disabilities or who are ill or have an impairment. This includes swimming in a pool with chlorine, running in a pool without water or a swimming pool with a restricted entry of 1 person or less which do not give an exemption. — In addition, for some competition swimming arrangements, including some sanctioned by the PwC, children and young persons aged 16 and over must be permitted. This includes competitive swimming in some sports, such as rowing, swimming in some water sports (swimming pool, water skiing or water ballet) and competitive sport swimming (kayaking, rowing, water ballet, water skis (Rowing). The majority of other swimming arrangements are open to all children aged 16 and over. — All children and young persons who seek to participate in a competitive swimming competition or swimming pool must apply to have their application approved and be cleared through to the competition and swimming pool. The application should include the requirements of these rules. The Board of Directors has the general responsibility to oversee and control the running of the association in terms of its rules. This includes the maintenance of safety standards in conjunction with the appropriate authorities and their agencies as required. — The Board of Directors, except the President and Secretary, shall act only after applying, having cleared and considered any complaints received in respect of any member. The complaint and its responses (whether successful or not) will serve as the basis for the Board of Di rectors to decide on any disciplinary measures that may be required in relation to any of the Board of Directors members In cases of extreme gravity, such as cases of child abuse and exploitation or extreme cases of violence and risk and threat involving children in the association, all the decisions taken by the Board may be challenged in a final hearing before an independent tribunal under the Fair Trials Act.
