For each of the first five categories of persons in question, the applicants were asked to name the persons who had applied in their stead. If the applicant had no other valid documentation, he could not obtain an applicant number unless he was entitled for asylum. The criteria of the applicants are not the same. On 20 September 1994, the first group of applications were transmitted to the National Immigration Office by the Regional Office of Vienna. Only the group of Hungarian applicants was received in Vienna. On 13 June (by date of entry into force of the decision in question) it was decided on the applicants' entitlement to compensation for wrongful expulsion as per the provisions of the European Convention on Human Rights, the Vienna Convention on the Law of Treaties and the Vienna Convention on Consular Relations (see 4, paragraphs 6 and 9). The decision as to compensation for wrongful expulsion of Hungarian applicants entered into force on 21 June 1996. Before that date, all Hungarian applicants for asylum at the Regional Office of Vienna were entitled to compensation. However, an exception was provided to individuals who claimed that they were not entitled to compensation because they had not submitted a claim for asylum in connection with their application for international protection as a Hungarian citizen (“Aromas”). A letter of confirmation was issued from the Regional Office of Vienna to Hungarian civil servants whose offices requested confirmation that the Hungarian applicants had been granted asylum. Only a total of 30 Hungarian applicants had applied for international protection in connection with their applications for refugee status at the Regional Office of Vienna up to that point.
