The bonus scheme is very complex and has been complicated by the introduction of the reporting rules from 6 April 2012. The bonus schemes are administered under the Income Tax (Additional Compensation) Act 2010. The tax treatment of bonus schemes is complicated and this article aims to give guidance to tax advisors dealing with bonus schemes. HMRC's position in relation to the bonus schemes has changed in recent years in response to the increased use of these schemes and the impact they have on the tax system's provision to the UK and, ultimately, the tax return of the taxpayer. The following guidance will focus on advice to tax advisors on bonus schemes which are paid as tax credits. 2 Tax advisors will be able to help a range of clients in relation to the bonus scheme for which they have been advising, including individuals and companies. 3 3.1 Introduction 3.2 How bonus schemes can fall foul of UK tax law The bonus schemes are complex and there are a number of issues which might affect the tax treatment of the scheme or which are of interest to the advisor. The following paragraphs outline some of the issues which might affect the bonus scheme. 3.2.1 Payments to the employee In the recent tax year 2011/12, HMRC received approximately £6 billion in bonus payments and over £1.0 billion in pay to the taxpayer from these schemes (the most recent figures). The total bonus payments for the whole of 2012/13 was over £14 billion, an increase of 3.0% over 2011/12. It is essential for an advisor to understand that these payments are taxable under Section 55 of the Income Tax Act and that any gains in respect of such payments will be taxed at the highest rate of tax applicable in any one year. In the case of bonuses paid to individuals, this means that any gains in respect of such payments will be subject to income tax at the rate of 40% where applicable, at 40% in any other tax year and at 40% in any month in any one year. This rule has no force in respect of non-domiciled individuals. Non-domiciled individuals and some UK residents have non-contributory 'non-qualifying' bonus schemes (see paragraph 3.4 below).
