The MID instrument will be used as an instrument to obtain conformity assessment as required by the Conformity Assessment Directive of 2005/18/EC. (N.B. In all cases an external reference in accordance with the EN 61922/2 or EN 61922/1 must be used to establish conformity. The external reference must be an instrument that has been approved by the Commission. 2. 1.3. On application by the responsible Party to the MID and on approval by us, if the document referred to in paragraph 1.2. Is not available for the measuring instrument then we recommend that a third party, e.g. a professional laboratory that has received the documents referred to in paragraph 1.4. And a relevant test certificate and a list of the test results submitted by the manufacturer, performs the conformity assessment. In case it cannot be determined by the third party whether the measurement device conforms to the standard, if the document refers to a third party the manufacturer, for reasons mentioned in paragraph 1.4. Will have to submit the documents to us. 2. A third party, e.g., a professional laboratory that has received the documents referred to in paragraph 4.5. And an external reference in accordance with the EN 61922/2 or EN 61922/1, will have to perform conformity assessment in accordance to the procedure set out in the instrument supplied by the manufacturer. If a third party performed the conformity assessment on our part we will require the certificate of the third party to be issued to the responsible Party within 6 months of any test results issued by the third party. If the external reference (the third party) is approved by the Commission the conformity assessment procedures in paragraphs 2.4., 2.5., 3.1., 4.1. And 4.3. Shall apply to the measurement instruments of third parties that did not obtain an external reference within the 6 months mentioned in the previous paragraph. 2.4. We recommend that if we are notified of a measurement device that has been submitted to a third party to test it and that test results show that the device does not conform to the current standard, the third party should immediately submit the instrument, the test certificates and the list of test results to us for examination by our Technical Director.
