LEGISLATIVE COUNSEL'S DIGEST S3. As adopted by the Senate on April 21, 2011, Senate Bill 324 (Lee, Leland) was referred to the Committee on Commerce, Labor and Energy. A report filed by the committee found that, in general, property taxes have been increasing in North Dakota since the 1990s. There are a number of factors contributing to the rising property tax rate, including the state's economy, the aging and decline in population, an increased cost of living, a decrease in real estate valuations, and increased business taxes. According to a January 2011 Economic Outlook issued jointly by the state Department of Commerce and the Legislative Fiscal Bureau, there will not be any significant changes in the rate of increase of the state's total sales tax rate in the coming years, due to the state's projected economic growth. A 2012 report by the Department of Commerce and Bureau of Economic Analysis indicates that sales and usage tax data from the previous two years indicate a gradual decrease in retail sales tax rates. A report issued by the Department of Finance indicates that property tax revenues will increase by 41.0 million between fiscal years 2010 and 2011, due to increased property value. On the other hand, there is an ongoing struggle between the state and community and individual property owners in certain communities regarding assessments of assessed property values. For example, there are several communities outside Fargo and Bismarck, in which assessments have increased substantially, and there are numerous communities in which assessments have increased slowly. Although municipalities, including the City of Fargo and the town of Bismarck, are responsible for funding much of the property tax burden of municipalities with smaller populations, they are also required to provide local government services and programs at a minimal level to maintain the funding that is collected. Some municipalities have experienced budget deficits and financial challenges. The report released by the Economic and Fiscal Analysis Division of the Department of Commerce and Bureau of Economic Analysis indicated that, at the end of fiscal year 2010, the total unallocated expenditure revenues to all municipalities were: Fargo 23 million, Bismarck 20.0 million, Grand Forks 18.6 million, Bismarck County 16.9 million. (S.B. 324) The report noted that the state's total budget was 10.2 billion in 2010. The report further indicated that the total unallocated budget revenue to all municipalities was: Fargo 2.1 billion, Grand Forks 2.
