Use of the transmittal and cost reports is at the state, territorial, or local level. The administrator determines how best to meet the needs of beneficiaries. State and territory cost reporting coordinators are responsible for producing the documents and disseminating them to their respective beneficiaries. HHS recognizes that some cost reporting states, such as New Jersey and Louisiana, are not subject to the requirements of this Manual, and that other requirements, such as electronic submission, are still in effect. For these jurisdictions, use of this Manual may be necessary under appropriate circumstances, and may be required. (1)(a) HHS may require state and territory cost reporting coordinators to comply with the requirements of this Manual where it determines that the cost reporting is necessary to implement a program under the National Health Care Program. The costs reported in accordance with this section shall not be considered to be administrative costs. (b) Except as specified on pages 1, 3 and 5 of this Manual, a state or territory must use the cost reports and receipts developed by the state or territory pursuant to this section and this section for any year with more than one billing cycle. (2) A state or territory may elect to develop its own administrative information system (IIS). A state or territory may elect to use the federal Centers for Medicare & Medicaid Services (CMS) IIS data set. A state or territory may elect to develop its own administrative information system program. If the state or territory uses CMS IIS data set (CMS-3), a state or territory may choose to use CMS IIS, instead of the default CMS-3 cost management data set. CMS is also able to produce customized cost reports using the cost management data sets CMS is able to produce customized cost reports based on the state or territory's IIS.
