The public utility missions stated in their reports that the current law allows utilities to collect a reasonable profit as a result of the return on their assets. In the past, as the value of the work in progress has increased, utilities have been allowed to use their own money or borrowed funds, but they were prohibited from paying the actual cost of a public work in progress directly to the utility. If a utility's work in progress exceeds 25,000, the utility could use its own money to pay for the costs of any public work in progress. When the Legislature passed the 1977 energy conservation law, it did, however, limit the amount of money that could be used to fund public works in progress until they are certified to be in good repair. The Legislature limited the amount of the permit fee that can be collected for a work in progress to the fair market value of the work in progress during the last two months of the calendar year in which the work is filed. The Legislature did, however, exempt any work in progress in any county from the permit fee.
