Thank you, Mr. Chairman, and Senator Kevin and I thank the Subcommittee on Financial Institutions and Consumer Protection for this opportunity to submit written testimony regarding compliance with these requirements and our other obligations under the Dodd-Frank Wall Street Reform and Consumer Protection Act with respect to Security-based Swaps and Other Derivative Products--the swaps and derivative products described in our March 16 statement. The requirements under the Dodd-Frank Act are the result of an extensive effort by Congress to enhance the accountability of commercial and investment banks to the American public. Since that time, regulators have conducted numerous reviews, provided information, and consulted with the various trading firms to ensure a seamless implementation. To ensure the most thorough coverage, we submitted comment letters to the Office of the Comptroller of the Currency, National Credit Union Administration, Federal Deposit Insurance Corporation, and the Federal Housing Finance Agency (FIFA), seeking detailed comments and any proposed rule revisions. As part of the effort to make sure that the required regulations are well-implemented, and to ensure that the rules are adequately focused on their intended purpose, Congress also directed the Comptroller General (CGA) to conduct an independent review of the regulations and the regulatory structure to ensure that the Department of the Treasury had, or would have, the appropriate authorities to implement the regulatory structure, as required by law, and that the regulatory structure was consistent with the intent and structure of the Dodd- Frank Act. In December 2010, we received a report from the GAO that was completed in January 2011. In its report, the GAO reviewed many of the comments received and identified significant areas where there were substantive differences of opinion among regulator representatives and the various industry bodies. These differences included matters relating to implementation of the rules, as well as issues raised by the trade associations about the costs and benefits that were associated with the new regulation. It is important to note that the GAO did not find any evidence to support the allegation that the Department of the Treasury's (Treasury) regulation is inconsistent with the intent of the Dodd- Frank Act. We have been working for many months now to address those issues. There was no evidence that the Treasury regulations were inconsistent with the Act or with the Federal Reserve statutes.
