The purpose of the permission is to allow the City of Toledo to complete an Ohio Environmental Protection Agency-approved plan to reduce pollutants discharged into the City's sewage system. The City anticipates that the discharges will be used primarily for domestic industrial, commercial, sanitary, and municipal purposes. The discharges also will reduce the amount of storm water and industrial runoff flowing into Lake Erie. A copy of OEPA's Record of Decision is available at. The discharges would create a discharges control basin approximately 40,000 square feet in which the discharges would be discharged continuously and directly into a shallow section of the lake water, including a section about 25 feet high, approximately one-third of the waterway from the east end of Mercer's treatment facility to Mercer's disposal ponds. Mercer's proposed discharge of wastewater into Lake Erie may be accomplished by using, for discharges into Lake Erie, a conveyance or conveyance system consisting of a submerged or otherwise closed, horizontally or vertically sloped pipe or pipe-like apparatus carrying wastewater to the waterway from the treatment facility or from the discharge system to each designated treatment, disposal, and overflow point. The conveyance system would pass by each waterway and would include a control valve or gate system that would stop the conveyance system when a designated treatment facility of a specified size, for a specified discharge amount, shall be closed in order to prevent the discharge from reaching Lake Erie. In order to prevent the discharge from reaching the lake, the control valve or gate system would require a sufficient pressure of water from the lake to close a portion of the facility having a specified size. Mercer has constructed discharges control devices into the Lake Erie basin which will allow the discharges to be routed down into the Lake Erie.
