A. Background In 2007 Anthony Monad, DBA F.I.R. was issued a discharge permit for the Anthony Monad property in Franklin County that discharges water from a sewage treatment facility of unknown design and construction. The permit was filed with ODOR and the Ohio Environmental Protection Agency (OEPA). The facility is located on property that was previously identified as a Class C Superfund site by the Ohio State Agency for Health Services. The EPA identified at least one probable cause, which resulted in the issuance of a “No Significant Impact” letter to Anthony Monad, DEAF. According to the EPA, the “Sewage Treatment Facility” used by Anthony Monad, DEAF, did not comply with national specifications for sewage treatment, and as a result, it discharged the waste into a stream that runs within an Ohio designated Superfund site, the Anthony Monad property. The EPA issued the letter on April 24, 2010. In response to the EPA letter, Anthony Monad, DEAF filed a response with ODOR in July 2010. In November 2010, ODOR issued yet another letter, citing Anthony Monad's noncompliance with the national specifications; the company was ordered to begin the proper remediation process.
