(7) If the applicant has not paid the actual taxes for the year, and the amount to pay is more than 400, the applicant for purposes of the refund shall pay the actual or estimated taxes owed by the application, such reasonable compensation to the applicant as will not exceed 250 per applicant, with interest thereon at the rate fixed by the Secretary of the Commonwealth. The applicant must pay interest to the State of Kentucky on overpayments of tax if such overpayments are not refunded. An overpayment of taxes at one time by an applicant shall not be a valid basis for a refund if such overpayment is refunded within one year after the year the overpayment was made to the applicant. A refund may be denied if the application is not made in accordance with the requirements of this Section. (8) The tax commissioner or his agent or the tax commissioner's representative shall retain the refund for the benefit of the State and such of his successors in office as the Commissioner of Revenue may prescribe and shall deposit for credit to the general fund of the Commonwealth such amount of the refund as may be authorized by the legislature. (9) Every amount refunded pursuant to the provisions of this subsection (b) shall be used by the Tax Commissioner of the State of Kentucky for the purposes set forth in Section 14-53. (10) No refund or rebate shall be made in the event of any deficiency tax paid or assessed against an operator's license, until the deficiency tax has been paid and the operator has been notified of the payment thereof.
