As defined in s. 893.045(20), “commercial fishing permit” means a permit issued under s. 934.28 that authorizes the holder to take fish by hook or line for the sole purpose of trade, profit, or exchange for commercial purposes. The department shall develop requirements for applicants for commercial fishing permits and the departments of agriculture and natural resources and conservation and natural resources and sportsman's foundation are not required to approve any application that would require an additional annual inspection prior to the first use of the commercial fishing permit. In issuing a permit under this section, the department shall issue a permit for one person who must be at least 16 years of age and who must have met the requirements for the permit pursuant to s. 934.29(4). Under this section, the department shall not issue permits for any other persons. Any person who exceeds the duration of the permit is subject to the penalties in s. 934.28 and s. 934.29. (3) The use of a commercial fishing permit is not required for the following activities: (a) Possession of, or consumption of, any food or drink by the recreational fishing boat or motorboat pilot, on a fishing boat, boat trailer or motorboat under 1,000 pounds in weight, while the recreational fishing boat or motorboat is being operated in accordance with and in line with the requirements set forth in subparagraphs (A) to (E) of this paragraph and SS. 893.042, 893.0831, and 893.0833; or (b) Transporting fish caught offshore by motorboat to the area where they may be consumed at a place other than a fishing boat or motorboat; or (c) Possession of, or consumption of, commercial fishing bait and equipment by a commercial fishing boat or motorboat; or (d) Use of any bait or equipment on any fishing boat or boat trailer or motorboat that does not be used principally for the purpose of fishing, except in accordance with rules of the commission. (a) The commission shall adopt rules regarding commercial fishing permits to implement this section by July 5, 1997; and (b) The department shall establish standards for the issuance and renewal of commercial fishing permits of the department and those standards shall be effective January 1, 1998.
