You may file written evidence of your position with the board at any time and shall appear personally, if you wish. You may file a joint appendix listing your positions and that of all interested persons (opponents) in your position, if such an appendix is legally allowable in Tennessee. Furthermore, you may appear with one other person who must appear on the premises at all times, and each such person must have prior written consent from the board, which authorizes such presence. All persons are entitled to the right to be present in person and to be represented by counsel. In the manner provided for in Tenn. Code Ann. 67-1-305(a)(1), no person may have a seat in the room where the meetings of the board are conducted, nor may the person have other seats. You may receive such mail and documents in the manner provided for in Tenn. Code Ann. 67-1-302. Notice of hearing to be made by publication. Notice of the date, time, time and place of the hearing and the time permitted to file written questions or other objections shall be given by publication once a week for 2 consecutive weeks in one newspaper of general circulation in the county in which the board is to be composed in accordance with Tenn. Code Ann. 67-1-305(d). Notice to all interested parties of the date and place of the hearing of the board at its public meeting to be held the 16th day prior to the date of the hearing or at the next meeting date of the board if the notice has been so postponed, shall be given by publishing notice of the hearing in one newspaper in the county in which the board is to be composed in accordance with Tenn. Code Ann. 67-1-305(d). The board shall schedule the date of the public meeting not later than ten days after publishing the notice at least twice in the week for which notice is given. At least two (2) weeks before the schedule date, the Board of Equalization and the Director of Tennessee Health Services or their designated agents shall hold a public meeting in the county in which the Board is to be composed to discuss the issues raised. At the meeting the board can vote either to approve the regulations or to modify or reject the regulations. At this meeting, the question is whether the proposed rules should be adopted or modified.
