(3) Any citizen of the United States who is not a citizen of the territory of Puerto Rico (including Guam), who was unlawfully present before July 1, 1924, or who has been unlawfully present in the United States on and after July 1, 1924, and who, after August 5, 1952, and prior to any subsequent order denying lawful presence, has not been absent from the territory of the United States and the District of Columbia for a continuous period of not less than 1 year, is an alien; notwithstanding any other provision of this chapter, the Secretary of State may make an alien's adjustment of status subject to conditions not inconsistent with this section and may establish procedures for determining such conditions.
